These Terms of Service ("Terms") govern your use of the SpellJam iOS app and website at spell-jam.com, operated by Brand Finesse ("we", "us", or "our"), based in Ireland.

By downloading, installing, or using SpellJam, you agree to these Terms. If you are setting up SpellJam for a child under 13, you are agreeing on their behalf as their parent or guardian.

If you do not agree to these Terms, please do not use SpellJam.

📱 The Service

SpellJam is an educational spelling practice app for iOS designed to help children learn and practise spelling through interactive games, study tools, and progress tracking.

We offer:

• Free tier — Core spelling practice, study mode, weekly tests, and basic word management
• Premium features — Additional features available via in-app subscription through Apple's App Store

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice where possible.

👤 Accounts & Eligibility

SpellJam is intended for use by children under the supervision of a parent, guardian, or teacher. To create an account:

• You must be 13 or older, or have a parent or guardian create and manage the account on your behalf
• You must provide accurate information when setting up a profile
• You are responsible for maintaining the security of your account
• You must notify us immediately at hello@spell-jam.com if you suspect unauthorised access

We reserve the right to terminate accounts that violate these Terms.

💳 Subscriptions & Payments

Premium features are available through auto-renewing subscriptions purchased via Apple's App Store. By subscribing:

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• No refunds are provided for partial subscription periods, except as required by applicable law

✅ Acceptable Use

You agree to use SpellJam only for its intended educational purpose. You must not:

• Use the app for any unlawful purpose or in violation of any regulations
• Attempt to reverse engineer, decompile, or extract source code from the app
• Use automated tools to access, scrape, or interfere with the service
• Upload or input content that is illegal, harmful, offensive, or infringing
• Attempt to gain unauthorised access to our systems or other users' accounts
• Impersonate any person or entity

📚 Your Content

SpellJam allows you to create custom word lists and add your own spelling words. You retain ownership of any content you create.

By adding content to SpellJam, you grant us a limited licence to store and display that content solely for the purpose of providing the service to you. We do not use your custom word lists for any other purpose.

You are responsible for ensuring any content you add does not violate third-party rights or applicable laws.

🏆 Intellectual Property

SpellJam, including its name, logo, design, code, and content, is owned by Brand Finesse and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial educational purposes in accordance with these Terms.

You may not reproduce, distribute, or create derivative works from SpellJam without our prior written consent.

🛡️ Privacy

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your information — including our COPPA compliance for children under 13.

By using SpellJam, you agree to our Privacy Policy, which forms part of these Terms.

⚠️ Disclaimers

SpellJam is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The service will be uninterrupted, error-free, or completely secure
• Any specific educational outcomes will be achieved
• The service will be available in all regions at all times

SpellJam is designed to supplement, not replace, formal education. We are not responsible for academic outcomes.

⚖️ Limitation of Liability

To the maximum extent permitted by applicable law, Brand Finesse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of SpellJam.

Our total liability to you for any claim arising from these Terms or your use of SpellJam shall not exceed the amount you paid us in the 12 months prior to the claim, or €50, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

🔄 Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or by email. The "Last updated" date at the top of this page will always reflect the most recent version.

Continued use of SpellJam after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using SpellJam.

🌍 Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts, except where mandatory consumer protection laws in your country provide additional rights.
